Law on Amendments to the Law on Copyright and Related Rights

Montenegro has recently modernized its Copyright and Related Rights Law to align with EU legislation, focusing on digital-age adaptations and enhanced online content protection.

Key changes include new regulations for online content-sharing platforms, rights for text and data mining in research, and strengthened protection of authors’ economic rights.

The amendments introduce compensation for photocopying services and establish a collective licensing system with extended effect. Content platforms must now obtain proper authorization from rights holders, while publishers receive new protections for online content. Authors benefit from increased transparency through mandatory annual reporting on work usage and revenue.

These changes create a more robust framework for copyright protection in the digital environment while ensuring flexible enforcement mechanisms and the preservation of cultural heritage. The full analyses (in Montenegrin and English) of the new regulations provided by Marija Živković, Partner, and Mina Čogurić, Associate can be found here.
