Another JPM & Partners Arbitration Success

JPM & Partners has successfully secured a significant arbitration win in a complex, high-stakes dispute!

On 24 March 2025 the Sole Arbitrator issued the Final Award granting almost all reliefs in favour of JPM & Partners’ clients.

In the dispute conducted in accordance with the ICC Rules, the claimants were the Spanish company Aqualia Intech, S.A. and its Montenegrin subsidiary Aqualia Infrastructuras Montenegro d.o.o., who were the contractor on the project of construction of the wastewater treatment plant. The respondents, advised and represented by JPM&Partners, were the Municipality of Pljevlja, the employer, and the public utility company for Vodovod d.o.o. the beneficiary.

The dispute concerned the construction of the wastewater treatment plant in Pljevlja. The project was executed under the provisions of the FIDIC Yellow Book. The claimants were requesting extension of time and additional payments due to the delays attributable to the respondents. Additionally, they requested the Sole Arbitrator to establish termination of the contract was lawful Finally, the claimants sought the return of the retention money and return of the performance security.

The Sole Arbitrator issued the Final Award dismissing almost all of the claimants’ claims while obliging the claimants to reimburse to respondents for the costs and fees of the arbitration proceedings.
